IUJK (Permit for construction services)

Permit for construction services (IZIN USAHA JASA KONSTRUKSI - IUJK)

All companies planning to enter construction sector - companies (both existing & new companies) starting construction services or wishing to become a contractor consultant (KONTRAKTOR & KONSULTAN) in construction field need SIUJK or permit (IUJK) for construction. IUJK is a permit essential for winning a private or governmental tender, and the Board of Management Development Institutions' National Construction Services (LEMBAGA PENGENBANGAN JASA KONSTRUKSI: hereinafter referred to as LPJK) has control over IUJK
LPJK grades construction companies (klasifikasi, kualifikasi dan kemampuan) for their business types, conditions and possibilities (klasifikasi, kualifikasi dan kemampuan).
To get IUJK, construction company must win a tender or project, or prove its financial health in capital sector.
    • IUJK is issued only to the companies planning to invest in Indonesia.
    For licensing and non-licensing of SIUJK for companies described in the Clause 37, please refer to the BKPM (Indonesia Investment Coordinating Board) Regulation No. 5 of 2013.

    Current regulations on the issuance of IUJK follow LPJK Regulation No. 10 announced in 2013.

    In addition, Indonesia lightens taxes for companies holding IUJK.

    Final PPH in construction sector which is stipulated in the clause 4-2 UU PPH and PP No.51 of 2008 and JO. PP No. 40 of 2009 is issued only to a construction company that received a permit or operation license for construction services from legally authorized associations (ex. LPJK), and if a license or permit that the company is holding is valid, regulated TARIF is

    2% for business operators with little capital to obtain JASA PELAKSANAAN KONSTRUKSI,
    3% for business operators with medium or large capital to obtain JASA PELAKSANAAN KONSTRUKSI, and
    4% to obtain a license or permit as a supervisor or PROYEKTOR JASA (applicable to little, medium and large capital) to obtain

    If SUB is cancelled (For example, if business operator forget to deposit money or extend SUB due to indifference or negligence), final PPH rate is applied as follows.

    4% for construction of a building (JASA PELAKSANAAN KONSRTUKSI)
    6% for supervisor or planner (JASA PERENCANA MAUPUN PENGAWASAN)

    If it turned out that a construction services provider does not hold a permit or operation license from legally authorized associations (was not issued SBU from LPJK), PPH varies from the final PPH mentioned above.

  • Regulation for obtaining IUJK
    Applicant may obtain IUJK officially-registered in LPJK through the following steps.

    1. Step1: Issuance of SKA(Certificate of Expertise) & SKT(Skills Certificate)
      SKT which is a license issued to construction engineers starts from grade K2 and is divided into K3, M1, M2, B1 and B2. SKA is a license granted to skilled workers with competence and prospectiveness in construction services / planning / construction supervision categories, which is divided into three grades as follows.

      1. Beginning SKA
      2. Intermediate SKA
      3. Advanced SKA
      4. SKA is divided into stages from M1 to B2 according to the type of companies.
    2. Step2: Registration certificate KTA (Kartu Tanda Anggota Asosiasi), a proof of membership at the Construction Association Registry
      KTA is a proof of membership at the Construction Association Registry that a company registers according to the type of company. Not all categories and sub-categories of a company need to register in a same association. Association registered in the LPJKN (Construction Services Development Board) is an officially-approved association, and a company must possess a skilled worker holding a license or obtain SKT and SKA to become a member of the association
    3. Step3: Issuance of SBU (legal entity certificate)
      SBU is an official approval showing grade/internal competence and company’s ability depending on the types and conditions of business. To obtain IUJK, company must possess SBU and attach a certificate of SKA, SKT and a proof of membership at the Construction Association Registry which is one of regulations on SBU preparation process (tahap 1 & 2).
    4. Step4: Application for IUJK
      Upon completion of the above step 1 through 3, documents that your company submitted and other enclosed documents will be examined thoroughly, and your company will go through the steps for obtaining IUJK and will be allowed to take part in tenders with registered IUJK.

SBU (SERTIFIKAT BADAN USAHA) which is a license for a registered construction company is the most important document that must be attached to participate in tenders, and a document that all companies providing construction services in Indonesia must prepare.
It is also one of basic documents that all companies must prepare to apply for IUJK.
  • SBU is issued to the following construction companies in accordance with qualification and classification stipulated in LPJK regulation.
    1. Construction company or contractor wishing to carry on a business in Indonesia
    2. Construction consultant or company with a plan for supervision
    3. To obtain SBU, KLASIFIKASI BIDANG & SUB BIDANG for a project or tender is positively necessary.

Expert certificate (SKA) is an authentication certificate issued from LPJK and is a license issued to professional manpower (Konsultan) taking responsibility for sectors of construction planning and supervision
  • Qualifications of SKA are classified as follows
    1. Advanced level expert
    2. Intermediate level expert
    3. Beginning level expert
  • SKA is a regulation on the registration and authentication of construction services.
    One of the most important requirements for construction companies to register construction services and apply for Legal Entity Certificate(SBU) is to own professional manpower holding SKA to determine technical officer (PJT) or sector manager (PJK).
  • SKA is a professional(Konsultan) in construction planning and supervision sector.
    All construction companies applying for Legal Entity Certificate(SBU), especially medium-scaled (classified as M1, M2) and large-scaled (classified as B1, B2) must designate professional manpower holding SKA as technical officer (PJT) and sector manager (PJK) in accordance with SKA regulation.

SKT(Skills Certificate))

SKT is a certificate issued from LPJK, and a license issued to competent construction professionals who completed scientific training and fulfill the necessary conditions of the area.
  • SKT is classified as follows.

    3. Grade 1: Beginning level expert
  • SKT is the regulation on the construction companies’ registration and certification (Contractor).
    All construction companies applying for Legal Entity Certificate(SBU) and companies that received SBU for small-sized companies must hire a person holding Skills Certificate(SKTK) as a technical officer in accordance with regulation. SKTK is issued through another institute officially recognized by the association of construction experts or LPJK.

Location Permit(SITU)

Surat Izin Tempat Usaha
SITU is a workplace permit granted to a company or person not contaminating or destroying environment of a place where workplace is established.
To obtain SIUT (SURAT IZIN TEMPAT USAHA), a company must prove through various documents that it will not cause any loss or harmful influence on the place where workplace is established
SITU follows fundamental law on the approval of workplace of a region where each company is located, and legal limitations vary in different localities as it is regulated on the local government’s fundamental law on the ownership.
General limitations include close of business activity, and business operator may not obtain approval for other business activities.
Nuisance Act Permit(HO) is issued from a county unit which is the second level of the government, and must be extended or renewed every five years.

    3. To confirm if submitted documents are not different from facts, the government may inspect location of company’s workplace by deploying an official. If there is something different from the fact or documents are considered insufficient, government official may suggest guidelines.
    4. If all submitted documents are consistent with the facts and application fees are paid, SITU is issued within 14 working days.
  • Responsibilities of a person who obtained workplace permit (SITU)
    1. The company must initiate actual work within a month from the date of issuance of permit.
    2. The company must furnish tools to necessary for firefighting/fire/accident etc. in the workplace.
    3. The company must use every endeavor to prevent environmental destruction/contamination that may be caused by company’s business activities, and to keep environment clean.
    4. The company must keep public order and must not use sidewalk or public road while proceeding with work for smooth traffic of public transportation.
    5. The company must furnish household medicine (P3K).
    6. The company must be cooperative when a competent supervisor carries out surveillance.
    7. The company must follow instructions and explanations provided by the organization in charge of overall administration.
    8. The company is prohibited from using SITU in rural areas as a guarantee issued from the government.
    9. The company must submit a new application form 15 days before validity of SITU expires.
    10. The company must report to the governor of a country 60 days before the company closes its business.
    11. If company’s business activity is different from permitted details (even in case it is a little bit different), the company must report it to the governor of a county.
    12. SITU may be cancelled if the company does not initiate normal business activity within 1 year.

  • Issuance process of SKT MIGAS (Indonesia Oil & Gas Regulatory Body) application form:

  • Respective standard is as follows
    1. List of essential products is the list of products satisfying domestic quality regulations (having certificate of conformance and management system), and has TKDN+BMP Total >/= 40% and TKDN Product >/= 25 %.
    2. List of maximum allowable products is the list of products satisfying domestic quality regulations (having certificate of conformance and management system), and has TKDN+BMP Total<40% and TKDN Product>/= 25%.

    Products produced by a company get pass-fail evaluation through a test according to the grades that are commonly used in Indonesia.

On February 22, 2013, Energy and Mineral Resources Minister JERO WACIK announced MEMR Regulation No. 15 stating that regulations on the use of local content must be carried out in categories of oil and gas business activity for preferred use of local content in oil and gas business sector.

Regulations on the preferred use of Indonesian products aim at support for technical innovation of Indonesia and improvement of utilization rate of local content in oil business activities.
Supporting the policy for using local content, Energy and Mineral Resources Minister suggested objectives of TKDN clearly in the attached file, and established a roadmap for achieving objectives of TKDN in oil business activities to reach the goal.
According to the regulations, all domestic contractors, producers and product procurement or product supply companies and oil businesses assume an obligation to use and maximize local content satisfying quantity, quality and period of delivery in accordance with regulations on the procurement of product or service, promoting improvement of products

The Minister JERO mentioned regulations that his signature is attached saying “When carrying out procurement of products or service, all companies must use APDN Book as a standard regulating all the strategies and conditions of procurement.”

In principle, Directorate General of Oil and Gas(DIRJEN MIGAS WAJIB) is in duty to conduct research and evaluation of functions of local content for preferred use of local content, and carries out supervision of use of products, service, technology and domestic design ability on a regular basis for announcing the scope of SKUP MIGAS and renewing APDN Book.
SKK MIGAS’ goal to achieve use of local content - All contractors must specify work plan, budget plan or the list of procurement plan to achieve objectives of TKDN.

General Regulation

  • API regulation was re-summarized by the Ministry of Trade re-summarized on the Trade Minister Regulation No. 45/M-DAG/PER/2009(API) on September 16, 2009 for effectiveness of import policy.
  • Other than API application regulation, categories were arranged as two types of API-P, API-U from previous 5 types (API-P, API-U, API-T, APIT-U and API-K) for easier monitoring.
  • General regulation is as follows.
    1. API is composed of 2 types.
      1. API-P (Import License for manufacturing companies) is a permit necessary for companies that import goods to be utilized for their own purpose such as making a new product or used as parts of a product.
      2. API-U (General Import License) is a permit necessary for companies that import goods for the purpose of selling imported goods in their original form.
    2. Approved API can be used in all branches in Indonesia as well as in head office regardless of period, but can be issued only one kind of API at a time.
    3. Regulation on API announced by the Ministry of Trade is as follows.
      1. API-U and API-P are issued by the director of the local government office(KepalaDinasPropinsi).
      2. API-P is issued to the businesses or contractors handling natural underground resources such as energy, oil, natural gas, mineral etc., and doing business activities in cooperation with Indonesian Government.
      3. API-P is issued to the companies investing capital in the chairman of Indonesia Investment Coordinating Board (BKPM).
    4. API shall be reissued from an authoritative organization, but the validity continues as long as API holder keeps import activity. (Up to 5 years from the date of first issuance)
    5. API Policy revised as follows comes into effect from January 1, 2010.
      1. API-U and API-P issued by the director of the local government prior to the enactment of the regulation are valid only for 1 year after the regulation is amended.
      2. API-T or API-U issued by the Chairman of BKPM before the regulation was confirmed is valid only for 1 year after the Minister regulation became effective.
      3. API-K issued by the Director General(DIREKTUR JENDERAL) before the Minister Regulation was confirmed is valid for 3 months after the regulation became effective.

    API –U is issued to an importer handling imported goods as an essential activity for engaging in trade or the one importing goods for the purpose of selling imported goods. API – U is issued to a company importing goods with the purpose of selling the goods.

    Imported goods are limited to only one kind specified in the goods classification system in accordance with laws.

Special Importer Identification Number(NPIK – NOMOR PENGENAL IMPOTIR KHUSUS)

  • NPIK is a number indicated on the special imported goods that are designated in accordance with the Decree of the Minister of Industry and Trade No. 141/MPP/KEP/3/2002(Menteri Perindustriandan Perdagangan Republik Indonesia Nomor : 141/MPP/Kep/3/2002), and all companies importing the aforementioned item need to obtain the permit.
  • Types of imported goods that require NPIK as announced on the General Decree (March 7, 2002 NO./DJPLN/KP/3/2002) on foreign trade are as follows.
    1. Corn
    2. Rice
    3. Soybean(Pieces as well as in its entirety)
    4. Sugar cane or BIT and pure chemical(SUKROSA, DALAM BENTUK PADAT)
    5. Fabric and fabric product
    6. Shoes and feet-related tools
    7. Electronic elements
    8. Toy for children
  • Procedure and required documents
    1. Only the companies that already obtained API-U (import permit number for general businesses) and API-P (import permit number for manufacturers) are allowed to obtain NPIK.
    2. To obtain NPIK, companies must submit an import application form to the Director General(JENDERAL DIREKTUR) and its copy to the Director(DEREKTUR) in accordance with following regulations as stipulated in the Article (1).
      1. Documents necessary for companies holding API-U(General Import License) to apply for NPIK
        - API-U(API UMUM
        - Items that the company actually imported during the last 2 years in most recent 5 years, or items imported or purchasing contract that the company concluded an overseas business partner (MITRA DAGANG) in most recent 1 year
        - Company documents: bylaws, changed bylaws (Akta Pendirian, Perubahan& Pengesahannya), Company Domicile Certificate(Domisili), company’s Tax Identification Number(NPWP), Operation License(SIUP), Company Registration Certificate(TDP), manager’s KTP & legal representative’s KTP, company representative’s Tax Identification Number(NPWP)
      2. Documents necessary for companies holding API-P(Import License for manufacturing companies)
        - API-PRODUSEN
        - Operation License(IZIN USAHA INDUSTRI)
        Company documents: bylaws, changed bylaws(Akta Pendirian, Perubahan& Pengesahannya), Company Domicile Certificate(Domisili), company’s Tax Identification Number(NPWP), Operation License(SIUP), Company Registration Certificate(TDP), manager’s KTP & legal representative’s KTP, company representative’s Tax Identification Number(NPWP)
  • Processing Period
    Applicant may acquire NPIK after 14 business days from the date NPIK application form was submitted accompanied by all necessary documents
  • Validity of NPIK
    NPIK is valid for 5 years from the date of issuance

In the latest Pedoman Tata Kerja (Guidelines for Working Procedures) / PTK 007, there are some revisions as referred below:

  • KKKS, Goods/Service Provider, and Subcontractor should use local goods/service as listed in the APDN Book.
  • To be listed in the APDN book, KKKS, goods/service provider, and subcontractor should have SKUP Migas (Sertifikat Kemampuan Usaha Penunjang (Certificate of Business Support Capability of Oil & Gas))

  • SKUP MIGAS

    SKUP Migas is stands for Surat Kemampuan Usaha Penunjang Migas (Certificate of Business Support Capability of Oil & Gas), which issued by Direktorat Jenderal Minyak dan Gas Bumi (General Directorate of Oil and Gas), based on research results and assessment of domestic production capability, which involves business status, production capability (production result, standard/quality of products, production capability, TKDN and BMP value), management capability (quality/environment/K3), marketing networking and after sales service.

  • The procedure of SKUP Migas submission is as follows:

    The company shall submit an application for SKUP Migas. Fill out ‘capability of oil and gas supporting business’ form. Attach supporting documents/requirements, as listed below:

    1. Letter of Register ( Surat Keterangan Terdaftar (SKT) )
    2. Industrial Business License Letter(for industries)
    3. Agreements of AMDAL or UKL/UPL (for Construction and industry)
    4. Certificate of Management Quality, Environment, K3
    5. Certificate of Product Quality (for goods)
    6. Certificate of TKDN and BMP (for goods)

  • Stages of Process:

    1. Attending the presentation
    2. A survey to the location of applying Company
    3. If the verification result of company data meets the requirements, the General Directorate Migas will assess the company’s capability and will issue the Surat Keterangan Usaha Penunjang Migas (SKUP Migas) / Certificate of Business Support Capability of Oil & Gas.
